Overview

These Terms of Service govern your use of creatureculture.co.nz and your purchases from Creature Culture. By using the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site.

1. Our store

Creature Culture is a New Zealand fish and reptile store located at 6/781 Te Atatu Road, Te Atatū Peninsula, Auckland 0610. We sell and ship within New Zealand only. All prices are in New Zealand Dollars (NZD) and include GST where applicable.

2. Orders and payment

• All orders are subject to acceptance and stock availability. We may decline or cancel an order — for example where livestock cannot be safely shipped to your address — and will refund you in full if payment has been taken.
• Payment is taken in full at checkout via the methods listed on our Payment Methods page.
• Prices and product availability may change without notice. Obvious pricing errors may be corrected and affected orders cancelled and refunded.

3. Live animals

• Livestock is dispatched Monday–Wednesday only, via overnight courier, to protect animal welfare.
• Someone must be available to receive livestock deliveries. Our Live Arrival Guarantee requires same-day contact and a photo of any deceased fish in the unopened bag.
• Live animals cannot be returned once they leave our store, for animal welfare and biosecurity reasons.
• After delivery and acclimatisation, the health of livestock depends on your water conditions, tank mates, and husbandry, which are your responsibility.
• We may decline to ship livestock to addresses where safe overnight delivery cannot be assured.

4. Shipping

Shipping timeframes and costs are set out on our Shipping & Delivery page. Delivery timeframes are estimates, not guarantees. Risk in goods passes to you on delivery to your address.

5. Returns and refunds

Our returns policy — including change of mind conditions, faulty goods, and the Live Arrival Guarantee — is set out on our Returns & Refunds page and forms part of these terms.

6. Consumer Guarantees Act

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply. If you are purchasing for business purposes, you agree that the Consumer Guarantees Act does not apply to that purchase.

7. Product information and advice

We take care to describe products accurately and give sound husbandry advice, but keeping fish and reptiles involves variables outside our control. Information on the Site and advice from our team is general guidance, not a guarantee of outcomes in your specific setup.

8. Website use

• You may not use the Site for any unlawful purpose or in a way that could damage or impair it.
• Content on the Site (text, images, branding) belongs to Creature Culture or its licensors and may not be reproduced without permission.
• We may suspend or terminate access to the Site at our discretion.

9. Liability

To the maximum extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in this clause limits rights you have under the Consumer Guarantees Act.

10. General

• These terms are governed by New Zealand law, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
• If any part of these terms is found invalid, the rest remains in effect.
• We may update these terms from time to time — the version on the Site at the time of your order applies to that order.
